Investments in agriculture of the Far Eastern Federal District: legal aspect

Abstract

This article analyzes problems of legal regulation of investment activities in the Russian Far East. The author has paid special attention to the issues of attracting foreign investment in the territories of advanced socio-economic development, as well as in the development of mariculture. Basing on the general scientific and special research methods, there was made a conclusion that legislation contains some provisions decreasing attractiveness of the agriculture for foreign investors. From analysis of legal acts, judicial practice and scientific papers, there was proposed some ways of reforming the legislation. There is argued that restrictions concerning lease of agriculture land by foreigners should be revised. This will help to include foreign users of land in the legal field. The article highlights the need to increase the number of benefits to residents of the territory of advanced socio-economic development, investing in agriculture. It is argued that the peasant farms shall have a right to enjoy tax preferences of an ASEZ regime, which they may not receive today because peasants paying a complex agricultural tax are prohibited to get the status of an ASEZ resident. The article also emphasizes the low level of interdepartmental interaction between the public bodies and the Russian Ministry of Defense which causes annulment of the water plots lease. On the basis of the analysis performed, the author suggests possible solutions to named problems.
